Terms of use
The Hueblog Community, offered by appgefahren GmbH, Düppelstraße 18 in 44789 Bochum is a free offer, for which a registration is necessary for the active participation. The provision of this offer is subject to the following conditions, which the participant acknowledges and accepts by registering.
1. availability of the offers
Hueblog makes every effort to ensure the greatest possible availability of the offer. However, there is no guarantee for availability at any time and Hueblog does not promise such availability.
2. active participation and registration
The active participation in the offer can take place both under a real name and under a pseudonym. Registration also requires the entry of a valid email address, which the participant must keep up to date. The participant undertakes to provide all information within the scope of registration and use of the offer truthfully and to the best of his/her conscience. In the event that Hueblog is claimed by a third party due to contributions of a participant, the participant allows Hueblog to disclose his name and his email address as well as further personal data, as far as known, to the third party. This may include, in particular, the address and the IP address of the participant.
The passive use of the offer (read only) is possible without registration.
3. ownership of rights of the participants
Insofar as the participant uses the possibility to upload files into the database of the offer, he/she assures that he/she is the owner of the rights necessary for this, in particular the rights of use arising from copyright and trademark law.
4. infringement of rights by the participant and indemnification
The participant undertakes not to violate applicable law with his contributions. In particular, his contributions must not violate personal rights, trademark law, patent law, utility model law, copyright and/or competition law.
The participant shall indemnify Hueblog on first request from all claims, including the costs of legal defense, asserted by third parties against Hueblog due to a violation of this obligation by the participant.
5. exclusion of liability
Hueblog assumes no responsibility for the accuracy of the information provided by the participants of the site or its content. Furthermore, Hueblog is not liable for any damages that participants may suffer from the use of the offer, whether registered or unregistered, except in cases of intent or gross negligence on the part of Hueblog.
6. deletion of contributions / exclusion of users
Hueblog reserves the right to delete contributions of participants if they violate applicable law and/or morality. In cases of repetition, Hueblog may exclude the participant from using the offer.
7. applicable law
The law of the Federal Republic of Germany applies exclusively, excluding the conflict of laws provisions.
8. severability clause
Should one or more clauses of these terms of use prove to be invalid, the validity of the other clauses remains unaffected. The invalid provision shall be replaced by a provision which corresponds to the actual will of the parties involved.
Use of personal data
Hueblog stores personal data, which arise from the registration (“inventory data”) as well as the use of the offer (“usage data”) by the participant, in its computer systems. For the purpose of combating abuse, the IP addresses of the users are stored in particular.
The Hueblog uses this data to manage the user account of the participant and to inform about changes to the offer.
The data will not be passed on to third parties. Hueblog may deviate from this rule in the case mentioned in No. 2 of the terms of use and/or insofar as a legal obligation to do so exists.
The user hereby expressly agrees to the storage, processing and transmission of his inventory and usage data, in particular his user name, email and IP addresses. This declaration of consent and parts thereof can be revoked at any time.
